This Penalty case has a short compass. The Respondent here is the First Appellate Authority who had decided the First Appeal in 2 matters presented before the SCIC namely Appeal No. 108/SIC/2012 and Appeal No. 165/SIC/2012.

His explanation was called under Section 20(2) to know as to what administrative action he has taken for ensuring compliance of the order passed by him in First Appeal No. 22/2012 dated 20/02/2012 while working as Deputy Collector and SDO of Mapusa. He has filed his reply stating that he was transferred on 19/04/2012 i.e, within a month of passing order in First Appeal order No. 22/2012 on 20/03/2012. He therefore submits that in view of the above the notice issued to him under section 20(2) may be discharged.

I have considered his submission and agree with him. In view of the fact that separate Penalty case has been initiated against the then PIO, this Penalty case under section 20(2) is closed. Notice to Shri Jayant Tari is discharged. Order declared in open Court. Inform parties.
