RTI applies to
urban cooperative banks, cooperative financial institutions and other cooperative societies

Notwithstanding the myriad opinions and interpretations of several court judgments on
whether cooperative societies come under the Right to Information (RTI) Act, a recent
landmark judgment of the Aurangabad Bench of the Bombay High Court reiterates that urban
cooperative banks, cooperative financial institutions and other cooperative societies are
bound by the Act.

The Association of Jalgaon Zilla Urban Cooperative Banks, Credit Societies and other
financial institutions registered under the Maharashtra Cooperative Societies Act 1960,
appealed in a petition to the High Court that cooperative institutions cannot be treated as
public authority under the RTI Act.

They contended, “In view of the provisions of Section 2(h) and Section 8 of the Right to
Information Act 2005, cooperative institutions registered under the Cooperative Societies Act
cannot be treated as public authority.”

They also argued that under banking rules too certain information cannot be disclosed. Their
contention was that in view of the provision of section 34A of the Banking 3 WP 1304 of
2008 Regulation Act, 1949, these institutions are not bound to disclose certain information
which, according to them, is confidential in nature.

The petitioners also argued that “these institutions are not receiving financial aid from the
Government, directly or indirectly, and so the provisions of the Act cannot be made
applicable to them”.

The petitioners, in their prayer, urged the court to declare cooperative societies and others as
“not public authorities” under the RTI Act. Following was their submission:

 The urban cooperative banks, cooperative financial institutions, Patpedhis (credit
cooperative societies) and other cooperative societies, which are registered under the
Maharashtra Cooperative Societies Act 1960, are not public authorities within the
meaning of Section 2(h) of the Right to Information Act.
 These institutions stand exempted from disclosure of information u/s 8)1 (d), (e) and (j)
of the Right to Information Act
 That the court issue a writ, order or direction restraining the officers of the cooperative
department from supplying any information to the members or general public which is,
according to the said societies, confidential in nature.
 The court, pending the hearing and final decision of the writ petition, restrain the
respondent from disclosing any information other than the balance sheet and profit and
loss accounts of the cooperative societies, urban banks and Patpedhis to the general
public under Right to Information Act.

In its order issued on 13 February 2017, the court observed that cooperative institutions, are
registered under the Maharashtra Cooperative Societies Act, 1960 and that cooperative
societies and other such institutions are created by a statute; that they have a public authority
over them which is the final decision-making body.

Certain Articles of the Constitution also show that such institutions are discharging the duty
of the State and there is an ‘authority’ over them, which is the final decision-making body
and the co-operatives are bound to supply information (all of which comes under Section 2
(f) of the RTI Act), to this authority. Hence, cooperative societies and other such institutions
are bound to supply information under the RTI Act, the HC said.

The High Court observed:
 Cooperative institutions are bodies created by the statute. But right from the registration
till the liquidation there is control over these institutions by the authority created under
the same Act. The authority steps in to take decisions on the rights of the members. The
authority has control over the manner in which funds are invested or over the distribution
of the funds. Such institutions cannot act independently and the apex bodies are created
for such institutions.
 Even Articles 38,39,43 and 48 of the Directive Principles of State Policy of the
Constitution show that to some extent such institutions are discharging the duty of the
State
 The provisions of the Maharashtra Cooperative Societies Act show that the authority
under the Act can do the audit and inquire into irregularities. If loss is caused to the
institution, by the directors, promoters etc., the authority can assess the damage, and the
loss caused to the institution can be recovered from those persons. Under the Act, the
authority can suspend the managing committee and remove its members. For all these
and other purposes mentioned in the Cooperative Societies Act, the cooperative
institution is bound to supply the record to the authority.
 The provisions of the Maharashtra Cooperative Societies Act, if read with the definition
of information given in Section 2(f) of the Act, makes it clear that everything which is
mentioned in the definition of information needs to be supplied by the cooperative
institution to the authority created under the Cooperative Societies Act. The definition of
'Public Authority' given in Section 2(h) shows that such public authority can be created
by any law made by the State Legislature. It is already observed that the officers like

Registrar and his subordinate officers are appointed under the Cooperative Societies
Act.

The High Court therefore concluded that, “…the reliefs claimed in the present petition cannot
be granted as the reliefs can be used 14 WP 1304 of 2008 directly or indirectly by the
cooperative institutions to deny the supply of the information... This Court holds that no relief
which is claimed in the present petition can be given to the petitioner.”

RTI activist Vijay Kumbhar, who has been pursuing this issue for long, says, “After the
Supreme Court’s order in Thalappalam Services Cooperfative Bank Ltd. against State of
Kerala, public authorities and public information officers (PIOs) said the RTI act was not
applicable to cooperative societies. Actually even in the Thalappalam case, the apex court, in
paragraph 52 of its judgment, had categorically stated that the PIO of Registrar of
Cooperative Societies is duty bound to supply the information. But even then PIOs and
cooperative societies were denying the information sought under RTI.”

Cooperative Societies Act if read with the definition of information given in section 2(f) of
the Act, it can be said that everything which is mentioned in the definition of information
needs to be supplied by the cooperative institution to the authority created under the
Cooperative Societies Act. The definition of 'Public Authority' given in section 2(h) shows
that such public authority can be created by any law made by the State Legislature. It is
already observed that the officers like Registrar and his subordinate officers are appointed
under the Cooperative Societies Act and they have the control over the aforesaid things. In
view of these circumstances, the observations made by the Apex Court in the
paragraphs already quoted can be used safely when the
information is sought from the authority like Registrar or his subordinates
under the Cooperative Societies Act.Thus, the reliefs claimed in the present petition cannot
be granted as the reliefs can be used 14 WP1304 of 2008 directly or
indirectly by the cooperative institutions to deny the
supply of theinformation. The circumstances that the other matters were
allowed by this Court, other Bench of this Court, cannot come in the way of
giving present decision by this Court as the decision of theSupreme Court was not
there when other matters were decided by this Court. This Court holds thatno relief which is
claimed in the present petition can be given to the petitioner.The previous interpretation
made by this Court is not correct interpretation in view of the law laiddown by the
Apex Court. In the result, the petition stands dismissed. Rule is discharged.Civil Application
is disposed of.

PANJIM: “My propriety is to reduce the pendency of cases,” said Leena Mehendale, who was sworn in as Chief Information Commissioner Thursday.

Mehendale, IAS (retired) became the first woman CIC of Goa and was former additional chief secretary of Maharashtra. She took over the official charges Wednesday evening, almost three months after her selection on July 29, by a high level committee headed by Chief Minister Manohar Parrikar.

Governor of Goa Bharat Vir Wanchoo administered the oath of office and secrecy to Mehendale, in the presence of the Chief Minister, at a ceremony held at Raj Bhavan, Thursday morning. The office of the CIC would be temporarily housed at Shramashakti building at Patto and would be later shifted to GIM Ribandar.

A former Indian Information Service officer of 1974 batch (Maharashtra), Mehendale has served in positions like of Collector, Commissioner, Settlement Commissioner including as a judicial officer under various Acts, such as, Land Revenue, Tenancy, Watan Abolition, Land Acquisition, Resettlement, Municipal Act, Urban Land Ceiling and Departmental Enquiries.

After State government sent her the offer letter, Mehendale resigned as member of the Mumbai bench of the central administrative tribunal. Thereafter her appointment was challenged in the High Court via a petition which was dismissed earlier this week.

The post of CIC has been lying vacant for over 15 months and over 20,000 applications are pending before it with 2,000 adding every day. “My priority would be to reduce pendency,” Mehendale told media persons adding that she will take stalk of all pending cases before clearing it up.

Speaking about the Right to Information Act (RTI), Mehendale quipped that there is need for large participation of people in RTI Act. “Through this act (RTI), plans and policies of the government are known to the people and hence they can give their opinions,” she added.

CIC said that although the act gives a tool for the common man to keep a tab on functioning of the government, it cannot be used to the fullest till now, as it is still in the developing stage.

Speaking to media persons, later Chief Minister said that the new, redrafted circular on RTI making it mandatory for the RTI applicant to prove his Indian citizenship while moving an application under the act, would be out in next three-four days.

who was execcuting the work.The Assistant Engineer and deemed PIO has also not discharged his duty under RTI Act. However non -reply by both of them is not rhe cause of continued water shortage.

Anwway , before issuing ny penalty order,both PIO's must be given a chance to explain their position.

Hence I feel that there is need to issue direction to present BDO of pernem that he may issue advisory note to all the village Panchayat Officers working under him to be more vigilant in replying to the RTI questions within 30 days it under section 6 (3) within 6 days to the concerned dealing officers.

Now,no further information remains to be received . In view of the preayer of the complainant a notice can be issued to both PIO's under section 20(1) they can be given a chance.Hence I direct registry to start new penalty case and issue notices to both then village Panchayat officer for not transferring the RTI application in time and the then Assistant Engineer for not replying.

With this direction this complaint is closed.Order declared in Open court.Inform the parties.Open separate Penalty case and issue notices to then PIO and deemed PIO.

It is however evident that even if he had received the transferred RTI application at a much delayed date he himself has not taken care to give any reply to the Appellant .

As far as the RTI application is concerened it is a little flawed though the chagrin and anger of the common citizen is understandable when a small government scheme does not get completed even after 4 years, resulting in continued water shorteage, However ,the Q1 does not fit in the definition of information although it pertains to infficiency . It does not come not under the definition of information under section 2(f) of the RTI Act. The 2nd question begins by asking what is the standing position of work . This definitely falls under definition of information and PIO should have answered it.

The deemed PIO has no doubt filed the status of work before the Commission on 28/ 06 /2010 . He has not mentioned whether proper water supply has started yet to the purpose of the desiliting of Thank and counstruction of side walls.

The Complainant remained present on earlier dates but started absending after January2013 and continued to remain absent till 05/08/ 2014 which was the last date of hearing .An operative for dismissal was recorded in the Rojnama . However after the closure of the hearing the complaint as well as the present Village Panchayat Officer appeared before me and Ifind that nothing more remains to be supplied as far as the information asked is concerned .

Complainant has prayed for penalty for the then Village Panchayat Officer of Virnoda . The grounds stated at para 6 is that the information sought from ,the secretary of Village Panchayat was simple information and it was easily available in the records of the Panchayat , but the secretary intentionally refused to give information within 30 days ,hence,the Complainant had to suffer mentally and monetarily . This aspect is not fully correct . The mistake of the Village Panchayat Officer lies is not transferring the application to the concerned Assistant Engineer

This Complaint out of RTI application filed on 23/01/2099 before the PIO Village Panchayat Virnorda ,Pernem ,Goa .The appellant claims that she is the the affected person of shortage of Natural water supply from the lake that has been repaired before 4 years and yet the work is not completed .

Hence the information was asked for

1. Why is the said construction left incomplete?

2.At present what is the standing position of the said construction,is it taken up as per plans sanctioned?

This penalty proceeding arises out of Showcause Notice dated 27/05/2011 issued in view of SIC order dated 26/05/2011 in Appeal No. 151/SIC/2010.

In short the reply to RTI Question was given on 27/05/2010 only after the order of FAA, that to beyond the time limit given by FAA and that it was still incomplete. The then SCIC has taken this facts on record and he passed following orders.

Appeal is allowed. The Respondent No. 1/PIO is hereby directed to provide inspection of records as sought by the Appellant vide his application dated 14/03/2010 within twenty days from the date of receipt of this Order and on a mutually agreed date.

Issue notice Section 20(1)of the RTI Act to Respondent No. 1/PIO to showcause why penalty action should not be taken against him for causing delay in furnishing information. The explanation, if any, should reach this Commission on or before 29/06/2011. PIO/respondent No. 1 shall appear for the hearing.

Accordingly showcause notice was issued to the Respondent PIO Shri M.S. Mardolkar who has submitted his say on 21/06/2012. He submits as below.

The PIO was required to do Census duty from 01/04/2010 to 15/05/2010 in addition to his own duties. This resulted in delay. Since the 1^st Appeal was made on 20/04/2010 he took it that he did not give any information while the matter is submitted in 1^st Appeal.
After given order of FAA on 10/05/2010 he informed the Appellant telephonically to collect information where he kept ready but the Appellant collected it only on 27/05/2010.
There was no modified intension to hide or refuse information.
Hence the penalty proceeding may be dropped. The original Appellant has filed his rejoinder on 28/06/2012. He has denied having received any telephonic message on 10/05/2010 as claimed by PIO. He has filed a lengthy argument on the point has to why a delayed information should not be condemned.

The original RTI Question simply asked for a copy of Occupancy Certificate dated 29/11/2005 issued to AGM of BSNL and the other ownership documents furnished by the Applicant in the matter of approval of construction plant. Finally the Reply provided by the PIO is simply A2 page document, one page being copy of Occupancy Certificate further informing that being a titled informing that being a titled document are not on record. The submission submitted by PIO regarding the load of Census work is accepted to some extent but not point 2 made about.

The 1^st Appeal was clearly on the ground that he has not supplied the information which is his prime responsibility under RTI and when he himself was not given any information, then he does not have to wait for the order of FAA alongwith 2^nd Appeal the Appellant has filed some Annexures and page 6 contains a copy of the letter dated 12/05/2010 which invites the Appellant to visit the Office and verify and collect the information kept ready for him. This has been received by the Appellant on 17/05/2010 and has been collected by the Appellant on 27/05/2010.
