This
case has a short point. An RTI application made on 30/09/2011 to the
PIO of PWD, W.D. VI, Fatorda, Margao for inspection and information
regarding letter No. VP/SVC/179/79-80 dated 13/11/1979 from V.P. to
the PWD. The said letter is supposed to be in respect of permission
to construct a Farm House and the Plan (Site-map) thereof. This
information pertains to the document which is more than 30 years
old. A reply was given inviting him for inspection but expressing
that the matter was very old.
Finally
it was informed on 17/11/2011 that the information was not traceable
being old. The First Appeal decided by Appeal No. 288 of 2011
recorded that the PIO requested V.P. Colva to furnish information
but V.P. Officer has also replied that the matter is very old and
untraceable . The FAA has passed a detailed order directing PIO to
supply point wise reply within 10 days.
During
the hearing of second appeal, the Appellant filed an application on
01/04/2014 seeking permission to implead the V.P. Officer of Colva as
Respondent No. 3. This was permitted and V.P. Officer of Colva has
remained present on 11/07/2014. He explained that his earlier
Village Panchayat Officer has already shown the information to be
unavailable being more than 30 years old. He however agreed that he
can make one more search within next 15 days, if the Appellant is
not satisfied, he may approach the BDO who is the FAA for V.P.
With
these instructions, present appeal is partly allowed and closed.
