This Complaint arises from RTI applications dated 07/01/2010 made to PIO and Mamlatdar of Ponda. Reply was given on 28/01/2010 ( in time) and received by the Complainant on 06/02/2010. It stated-

With reference to your application dated 07/01/2010 on the subject cited above, it is found that “as per records of this Office no residence certificate have been issued to Smt. Vaijayanti P. Shet, Mr. Mahindra P. Shet and Ms. Manisha P. Shet resident of Durbhat, Ponda and presently residing at Flat No. D/202 Building ‘B’ Mitasu Marvel, Upper Bazar, Ponda. However, Ms. Milan P. Shet was issued residence certificate”.

A complaint was made directly to the Office of SCIC, without availing the remedy of approaching FAA. The Complaint was made on 24/2/2010 on following grounds.

• Though it is admitted that a Residence Certificate was issued to Ms. Milan P. Shet, a copy of the same was not given to the Complainant as asked for
• On 08/02/2010 the Complainant once again approached the Mamlatdar of Ponda pointing out that a certified copy of RC for Ms. Milan P. Shet was not furnished. He made additional demand to also furnish the documents filed by Ms. Milan Shet such as Educational Qualification, Employment Certificate etc.
• The PIO wrote on 22/02/2010 that a copy of RC for Ms. Milan Shet cannot be given, because the records are not available.

Aggrieved the Complaint was filed directly to SCIC on 24/02/2010. Notices were issued fixing the hearing on 04/05/2010.

Complainant was represented by his Advocate till 19/01/2011. Thereafter the case was adjourned on several occasions and the Complainant continuously remained absent. Hence it must be presumed that he has lost interest in the case. Moreover, the information asked is about third party and no public purpose is stated which would be achieved.

The PIO filed a reply on 04/05/2010 itself stating that he had informed about issuance of RC for Ms. Milan Shet. Further, in response to the 2^nd letter dated 08/02/2010 he has informed on 22/02/2010 that certified copy of RC cannot be issued since the record is not available. In past, to his other RTI queries, he has been giving all the information to the appellant Hence, the respondent had not acted with ill-motives or malafied intensions as alleged by the Complainant.

Complaint is therefore dismissed . Order declared in Open Court. Parties to be informed.
