This second appeal arises out of original RTI application filed before PIO and Dy. Director of Panchayat on 23/12/2011.

This case has a short compass. The appellant was called to inspect the files and document required by him. He was shown two files but he was given information pertaining to only one file. The FAA after hearing, directed that the copies of second file also be provided since this was not done. Second appeal was made on 18/04/2012. Appellant prayed for information as well as action under section 20 (1).

During the hearing the present PIO vide his letter dated 20/01/2014, provided all the records and proceedings of the second file which was the file obtained from Office of V.P. Penha- de- France in connection to Panchayat Appeal No. 190/2000 filed in the Court of Addl. Director of Panchayat – II, Panaji Goa.

It was stated by the appellant that he was now satisfied with the information and his prayer for information may be closed.

His prayer includes action under section 20(1) against the then PIO. However,in view of proper action by the present PIO, he wished to reconsider and stated that he would file separate application for penalty proceeding after giving due thought to the issue. He prayed for 2 months time after receiving present order. Allowed.

The appeal is therefore disposed as allowed and complied with by the present PIO. Order declared in Open Court. Inform the parties. If he wants to pursue penalty case u/s 20(1), then he may file a say as above after which a case may be started for giving opportunity to the PIO to explain his stand.
