1) This second appeal arises out of RTI application dated 22/02/2012 made before the PIO/Deputy Director (Planning), Directorate of Health Services, Panaji, Goa for providing Certified copies of file notings which resulted in three orders dated 11/11/2008, 09/11/2007 and 08/12/2008, each of them asking Dr. Vaingankar to attend/perform the duties as Health Officer in a given PHC.

2) The Appellant has remained present in the matter through his representative Dr. Vaingankar upto 03/10/2012 and has remained absent thereafter upto last date of hearing on 18/11/2014.

3) Copies of file noting have been supplied in time.

4) First Appeal is filed on the ground that file notings regarding order dated 11/11/2008 and 09/11/2007 are false. The FAA has not agreed with this.

5) I have pursued the notings filed by Appellant and I do not find them false. They do not mention name of Dr. Vaingankar, but simply say” as instructed, order is put up, may be signed”. This is a normal method for transfer order involving few transfers and no elaborate notes are required. PIO can give only the information as available in file, which he has done.

6) Appellant has never remained present except that on 1st day, Dr. Vaigankar himself remained present to represent appellant only on some occasions. They have never enquired about their appeal.

7) Appeal lacks merit and is dismissed.

The second appeal is dismissed as lacking merit. Order declared in Open Court. Inform the parties.
