1) This
Complaint arises out of two original RTI applications dated
15/09/2011 and 17/10/2011 made to PIO/The Health Officer, Urban
Health Centre, Vasco-da- Gama regarding action taken on letter number
VP/CB/MPDA/09-10/702 dated 02/03/2010 of Village Panchayat of
Chicolna and provision stating that approval of Town and Country
Planning for construction is mandatory for issuance of Health NOC.
2) Complainant
was part heard on 19/09/2014, when Advocate for Complainant submitted
that by now she has received the information and would file a
separate detailed prayer to pursue a penalty case.

3) Finally
on 27/10/2014, Complainant and his Advocate Devshekhar has given a
submission for starting penalty case u/s 20 (1).
4) Registrar
to start a new penalty case and issue notice to the Respondent by
name u/s 20(1) so as to give him a chance to explain his stand.

In
view of this the Complaint is partly allowed. New penalty case to be
started under section 20(1) against PIO by name.
